Can Texas Charge Trafficking Without Transportation?
Texas trafficking is not limited to moving people. Learn how recruiting, harboring, exploitation and knowledge fit the statutory definition.
In short: Yes. Texas defines trafficking to include several acts besides transportation, including recruiting and harboring. But the broad definition does not make every recruitment or housing arrangement a crime. Section 20A.02 supplies additional requirements that must be proved for the charged route.

Is providing housing enough by itself?
No. The full offense requires the relevant knowledge, purpose or other statutory circumstances. Counsel should examine the arrangement and alleged exploitation rather than assume that a lease or hotel reservation proves trafficking.
What evidence may show the actual arrangement?
Communications, payment records, employment terms and access to personal documents may matter. Review who controlled decisions and what each person knew. A single payment should be interpreted in its documented context.
How do child-related allegations differ?
Chapter 20A has specific child and disabled-individual provisions. Some sexual-exploitation routes do not require the adult force, fraud or coercion formulation. Do not apply an adult-consent argument without first identifying the victim category and exact subsection.
A practical example and questions for counsel
Hypothetical example: Suppose a person rented a room used by someone else. The rental record may establish access or payment without establishing the renter’s knowledge of alleged exploitation. Counsel should review who arranged the room, who controlled it and the complete communications. If the State relies on harboring, the broad definition of trafficking still must be connected to the additional offense requirements. This distinction prevents both an unwarranted assumption of guilt from a reservation and an unwarranted assumption of innocence merely because no transportation occurred.
How this fits Texas law
Texas trafficking law distinguishes forced labor, specified sexual exploitation and certain benefit-related conduct. “Traffic” has a broad statutory meaning that includes recruiting and harboring, not just transport. Child and disabled-individual provisions have distinct requirements. Chapter 20A has multiple recent amendments; offense date and the exact subsection require attention before giving sentencing advice.
