Financial Benefit and Texas Trafficking Charges

Can receiving money lead to a Texas trafficking charge? Learn the difference between a payment and the statutory benefit-participation elements.

In short: Section 20A.02 includes certain benefit-from-participation routes. Receiving money is not a substitute for proving the applicable offense, including its knowledge and venture-related requirements. The source of the benefit, the accused’s role and the alleged exploitation must be examined together.

Does every business payment establish knowing participation?

No. A payment’s purpose and surrounding evidence matter. Counsel should examine contracts, invoices, communications and the actual services rather than treat an unexplained transaction as conclusive.

Why does the charged subsection matter?

The benefit provisions refer to different underlying trafficking activities. Labor and sexual-exploitation allegations, and adult and protected-victim routes, do not have identical requirements. Trace the alleged benefit to the specific activity cited in the charge.

What should be preserved for counsel?

Keep complete financial records and the communications explaining transactions. Do not create backdated invoices or move funds to hide their history. Counsel can assess legitimate explanations and adverse facts against the actual statutory theory.

A practical example and questions for counsel

Hypothetical example: Suppose recurring payments are described as proceeds from trafficking. Counsel should trace the transactions to the alleged activity and examine evidence of knowing participation, rather than accept the label attached to the bank entries. A legitimate-looking invoice does not conclusively resolve the question either. Compare the documentation with actual services and communications. The review should identify the specific benefit provision, the underlying activity it incorporates and the evidence connecting this accused to it. Do not alter financial records to make them appear consistent with an explanation.

How this fits Texas law

Texas trafficking law distinguishes forced labor, specified sexual exploitation and certain benefit-related conduct. “Traffic” has a broad statutory meaning that includes recruiting and harboring, not just transport. Child and disabled-individual provisions have distinct requirements. Chapter 20A has multiple recent amendments; offense date and the exact subsection require attention before giving sentencing advice.
