Self-Defense and Deadly-Weapon Assault in Texas

Learn why Texas self-defense and deadly-force rules must be analyzed separately when an assault charge alleges a deadly weapon.

In short: A deadly-weapon allegation does not automatically defeat self-defense, and a claim of self-defense does not automatically justify using a weapon. Sections 9.31 and 9.32 govern different force questions. Counsel must examine the actual force, perceived threat, immediate necessity and statutory limitations.

Does being frightened alone establish justification?

No. The legal analysis includes reasonable belief and the applicable necessity requirements. Counsel should connect the claimed threat to specific observations rather than rely solely on a description of fear.

Can the sequence change the defense analysis?

Yes. Force used during an immediate threat raises different questions from force used after the threat ended. Record the sequence carefully, including pauses, movement and opportunities to perceive what was happening.

What should be discussed with counsel?

Identify the alleged assault subsection, the force actually used and the evidence of unlawful force by another person. Review complete recordings and injuries on all relevant sides. Do not contact the other person to obtain an admission or stage a reenactment.

A practical example and questions for counsel

Hypothetical example: Suppose both participants claim the other acted first. That dispute requires more than choosing which account sounds more confident. Counsel should reconstruct the timing of unlawful force, the response and any change in the threat. Recordings, injuries and witness locations may illuminate different portions. The degree of force used must also be evaluated under the applicable justification provision. Preserve facts that complicate the defense as well as those that support it; an accurate account allows counsel to assess the actual limitations instead of preparing around an incomplete narrative.

How this fits Texas law

Section 22.02 requires an assault plus serious bodily injury or use or exhibition of a deadly weapon. The underlying assault may involve injury or a qualifying threat. Aggravated assault is generally second degree, with listed first-degree circumstances. The weapon definition, actual manner of use and any claimed justification require separate analysis.
