Is possession of a vape pen a felony in Texas?

Published · Texas Criminal Defense Attorneys PLLC

In short: It depends on what is inside. A THC oil cartridge is usually charged as a controlled substance in Penalty Group 2, and possession of less than 1 gram is a state jail felony (Health and Safety Code 481.116). A nicotine vape is not a felony; for someone under 21, possession is a fine-only offense of up to $100 (161.252).

Why is a THC vape treated more harshly than marijuana?

Texas law treats the plant form of marijuana separately from THC extracted into oils and concentrates. THC oil in a cartridge is charged under Penalty Group 2 by weight in grams, and the weight can include the oil, not just the THC. Possession of up to 2 ounces of marijuana is a Class B misdemeanor, while even a small cartridge of THC oil can be a felony.

What about hemp, delta-8 and store-bought vapes?

A hemp product with no more than 0.3% delta-9 THC by dry weight is not marijuana or a controlled substance. Texas rules for other THC products changed on July 31, 2026. Whether a store-bought vape is legal depends on what the lab finds. See THC and delta-8 after July 31, 2026.

What about nicotine vapes for people under 21?

A person under 21 who possesses an e-cigarette commits an offense punishable by a fine of up to $100 (Health and Safety Code 161.252), with limited exceptions, such as when an employer requires it for the job. The court must tell the person about the right to seek expunction after turning 21.

What are common defenses?

Can a first-time vape case avoid a conviction?

Often there are options, such as pretrial diversion where available, a reduction under Penal Code 12.44, or deferred adjudication. Some outcomes keep expunction or nondisclosure possible.
