Is a THC vape a felony in Texas?

Published · Texas Criminal Defense Attorneys PLLC

In short: Usually, yes. THC oil in a vape cartridge is a Penalty Group 2 controlled substance, and possessing less than 1 gram is a state jail felony punishable by 180 days to 2 years in a state jail and a fine up to $10,000 (Health and Safety Code 481.116). Since July 31, 2026, that also covers delta-8 and other non-delta-9 THC vapes.

Why is a vape treated differently from marijuana?

Texas law defines marijuana as the plant. THC extracted from the plant, such as vape oil and wax, falls under Penalty Group 2 (481.103). Two ounces of plant marijuana is a Class B misdemeanor; less than a gram of THC oil is a felony.

How is the weight measured?

By aggregate weight, including the carrier oil and other ingredients. A typical cartridge can be close to or above 1 gram, which is the line between a state jail felony and a third-degree felony (1 to 4 grams).

What about delta-8 vapes?

Since July 31, 2026, Texas treats manufactured delta-8 and other THC isomers and variants other than delta-9 as Schedule I controlled substances, after the Texas Supreme Court's May 1, 2026 decision in DSHS v. Sky Marketing and the DSHS schedule that followed. A delta-8 vape bought in a store before that date is not protected. See THC and delta-8 after July 31, 2026.

Is anything still legal?

Hemp products with no more than 0.3% delta-9 THC on a dry weight basis (Health and Safety Code chapter 443). Whether a particular product qualifies depends on lab testing.

What happens if I am charged?

Many first-time state jail possession cases qualify for community supervision, and Code of Criminal Procedure 42A.551 generally requires it for some first-time cases, with exceptions. Deferred adjudication and diversion may be options. The lab report, the weight and the legality of the search are often the key issues.

How do police and labs test a vape cartridge?

A roadside field test can suggest that THC is present, but it cannot tell hemp-derived products from controlled THC or measure concentration. To prove a Penalty Group 2 offense, the State relies on a laboratory analysis that identifies the substance and weighs it. Ask for the lab report, the method used, and whether the weight included the cartridge hardware. The weight should be of the substance and its mixture, not the plastic and metal.

What is the timeline of a vape case?

  1. Stop or search, and seizure of the cartridge
  2. Arrest or citation, then magistration and bond
  3. Lab submission, which can take weeks or months
  4. Felony cases go to a grand jury; the case may wait for the lab result
  5. Discovery, negotiation, diversion or trial

What outcomes are common for a first vape case?

Depending on the county, the facts and your history, outcomes can include dismissal, pretrial diversion, a reduction under Penal Code 12.44, deferred adjudication or community supervision. For eligible first-time felony cases in Dallas County, the DA's general pretrial diversion program may be available if the referral is made before indictment or within 120 days after it.

What if I am under 21?

Young people can face both the THC charge and separate rules about tobacco and e-cigarette products. A felony record can affect college admissions, scholarships and jobs, so it is especially important to look for outcomes that allow the record to be cleared later.

How can the record be cleared?

A dismissal or completed pretrial diversion can lead to expunction. A completed deferred adjudication may qualify for nondisclosure after a waiting period. See expunction and nondisclosure.
