Drug Weight and Penalty Groups in Texas Delivery Cases

Understand why substance identity, penalty group and aggregate weight matter in Texas manufacturing and delivery charges.

In short: Texas drug-delivery exposure cannot be calculated from grams alone. The substance’s penalty group and applicable statute come first. For Penalty Group 1 under section 481.112, aggregate weight including adulterants or dilutants controls the listed brackets; other groups and enhancements require their own review.

Is a field-test label enough to calculate the final range?

Do not assume it is. Counsel should review laboratory identification, the charged substance and actual weight evidence. A preliminary description can differ from the proof ultimately offered.

Does one gram mean the same thing for every substance?

No. Chapter 481 uses different provisions for different groups. In section 481.112, one gram marks a change between specified brackets, but that chart should not be copied to Penalty Group 1-B or another group.

Which additional allegations should be checked?

Review any drug-free-zone allegation, prior-conviction enhancement and special statutory provision. Ask counsel to identify the legal basis and supporting evidence for each. The goal is an accurate range for the actual charge, not the harshest number found in a generic search.

A practical example and questions for counsel

Hypothetical example: Suppose a report places the amount close to a statutory boundary. Counsel should examine which substance and penalty group were confirmed, how the weight was obtained and whether the statute uses aggregate weight. Packaging weight should not be silently treated as controlled-substance weight. Also compare the charge with any laboratory revisions. Manufacturing allegations require proof of the manufacturing conduct in addition to identifying the applicable substance provision. The result should be a transparent calculation tied to the records, with uncertainties identified rather than rounded away for convenience.

How this fits Texas law

Texas controlled-substance manufacturing and delivery offenses depend on the substance, penalty group, amount and charged conduct. Chapter 481 distinguishes manufacturing, delivery and possession with intent to deliver. The same weight does not produce the same range for every drug. Fentanyl-related Penalty Group 1-B has a separate provision, so generic Penalty Group 1 charts should not be reused without checking.
