Drug Delivery Without a Sale in Texas

Does Texas drug delivery require payment? Learn how the statutory definition treats transfers and offers to sell controlled substances.

Published · Updated · Texas Criminal Defense Attorneys PLLC · Reviewed by the Marketing Team

In short: Texas section 481.002 defines delivery broadly and does not limit it to a completed cash sale. The definition includes actual or constructive transfer and an offer to sell. The charged offense still requires its applicable elements, including the required knowledge and controlled-substance proof.

Can a transfer without payment be relevant?

Yes. The statutory definition is not limited to payment-based transactions. Counsel should identify what transfer is alleged and what evidence connects the accused to that transfer.

Is an offer-to-sell allegation the same as a completed transfer?

No. They are distinct ways the definition can apply. The exact theory affects the evidence review. Messages must be assessed for identity, context and what was actually communicated, not just selected words.

What should counsel examine in a controlled-buy case?

Review the complete available recordings, identification evidence, substance testing and the chain of events. Ask what was observed directly and what was inferred. The existence of an investigation does not make every account or identification automatically reliable.

A practical example and questions for counsel

Hypothetical example: Suppose messages discuss a transfer but no payment record exists. The lack of payment does not necessarily defeat a delivery theory, yet the messages still require proof of identity, context and the charged substance-related conduct. If an offer to sell is alleged, counsel should identify exactly what was offered and the evidence supporting that account. If an actual transfer is alleged, review who observed it and how the substance was identified. The definition’s breadth does not relieve the State from proving the route it actually pursues.

How this fits Texas law

Texas controlled-substance manufacturing and delivery offenses depend on the substance, penalty group, amount and charged conduct. Chapter 481 distinguishes manufacturing, delivery and possession with intent to deliver. The same weight does not produce the same range for every drug. Fentanyl-related Penalty Group 1-B has a separate provision, so generic Penalty Group 1 charts should not be reused without checking.
