Bodily Injury vs. Serious Injury in Texas Child Cases

Learn why injury classification and mental state affect Texas injury-to-a-child cases, and how medical evidence should be reviewed.

In short: Section 22.04 treats bodily injury, serious bodily injury and specified serious mental harm differently. The mental state also affects classification. A medical diagnosis and the legal injury category are related but distinct questions; counsel should connect the records to the statutory definition.

Does every hospital visit establish serious bodily injury?

No. Section 1.07 defines serious bodily injury by specified consequences, including substantial risk of death and certain serious or protracted harm. Treatment alone does not replace the definition.

Does proving an injury prove who caused it?

No. Identity, mechanism, timing and causation require evaluation. A medical finding may document harm without resolving all of those questions. Counsel should identify what the clinician actually concluded and what remains uncertain.

How should competing medical explanations be handled?

Use qualified review of complete records and the proposed mechanism. Do not assume an alternative explanation is correct merely because it is possible. Ask what evidence supports it, what contradicts it and whether additional testing or records could clarify the issue.

A practical example and questions for counsel

Hypothetical example: Suppose records show a fracture, but the parties dispute when and how it occurred. The diagnosis does not automatically identify the responsible person or the mental state. Counsel should examine the medical timeline, proposed mechanisms and the statutory injury category. An expert’s estimate may have a range or stated limitation that matters to opportunity and causation. Preserve the complete report rather than only a summary. The legal review should connect each medical conclusion to the element it actually addresses and avoid treating a diagnosis as proof of the entire offense.

How this fits Texas law

Section 22.04 distinguishes the protected person’s status, the injury category, the mental state and acts versus omissions. A child here is 14 or younger; an elderly individual is 65 or older. The disability definition has additional statutory detail. Penalties vary substantially, so the accusation cannot be classified from the victim’s age alone.
