Can I Go Home After a Domestic Assault Arrest?
Release from jail does not necessarily authorize returning to the residence.
In short: You cannot return home if a current bond condition or protective order prohibits it. Read every applicable order before going back, even if you own the home or the protected person invites you. A private invitation does not change a court order; ask counsel about lawful clarification or modification.

Which documents should I check first?
Separate the bond conditions, any magistrate's emergency protective order and any civil protective order. Look for restrictions on addresses, distances, communication, children and third-party contact. These documents may coexist. One document's expiration does not prove every restriction has ended.
What if my partner asks me to return?
Article 17.292 requires an emergency order to warn that even the protected person cannot give permission to ignore it. Only a court change can alter its provisions while the order is valid. Keep the message without responding in a prohibited way and discuss it with your lawyer.
Does owning the house or being on the lease help?
Property or lease rights do not, by themselves, cancel an order restricting your presence. A dispute over occupancy and compliance with a criminal or protective order are different questions. Do not enter first and plan to explain ownership later.
How can I retrieve medication, clothing or work equipment?
Give counsel a specific list of essential items and the current orders. Ask what authorized arrangement or court relief is available. Do not assume a police standby, a third person or a brief visit creates an exception. Any proposed plan must comply with every applicable restriction before it happens.
What if we need to discuss children or bills?
Check the actual permitted communication, if any. A parenting application, family member or mutual friend is not automatically an authorized channel. Do not use children to carry messages. Ask counsel to address necessary logistics through a lawful arrangement instead of inventing an exception to a no-contact term.
What information makes a request to counsel useful?
| Bring | Explain |
|---|---|
| All current orders | Which addresses, people and communications are restricted. |
| The essential need | The exact item or task, why it is urgent and possible alternatives. |
| Any later court paperwork | Whether an actual signed modification exists. |
| Relevant incoming messages | What was received without treating it as permission. |
What happens if I misread an order?
Violating certain orders or bond conditions may create a separate charge under Penal Code 25.07 and may affect release. Do not rely on informal reassurance. If wording or overlapping orders are unclear, ask counsel to resolve the issue before you act. A request to modify an order is not itself a granted modification.

Common questions
Can I return if the protected person invites me?
Not if an applicable order prohibits it. A private invitation does not change the order.
Does being on the lease override a stay-away term?
No. Lease or ownership status does not itself cancel a court restriction.
Can I use a friend to pass messages?
Do not assume so. Indirect contact may be restricted; the actual order controls.
Do not wait for your court date to get help. Call (214) 239-2013.
