DWI With a CDL in Texas: Commercial Driving Risks

Your personal vehicle does not insulate your commercial driving privileges.

Published · Updated · Texas Criminal Defense Attorneys PLLC · Reviewed by the Marketing Team

In short: A Texas DWI can threaten commercial driving privileges even when a CDL holder is driving a personal vehicle. Transportation Code Chapter 522 contains separate disqualification rules. A license that permits limited noncommercial driving does not authorize commercial driving while disqualified.

Can a DWI in my personal car affect my CDL?

Yes. Do not assume CDL consequences apply only behind the wheel of a truck. Chapter 522 addresses disqualifying conduct involving commercial license or permit holders, including relevant conduct in other motor vehicles. Tell counsel both the vehicle involved and the license or permit you held at the time.

The criminal charge, an administrative license action and a commercial disqualification are related but distinct issues. An answer about one does not establish your eligibility for the others. The actual notice and its statutory basis matter more than a general description such as “my license was taken.”

What does the 0.04 commercial threshold mean?

Commercial rules include a 0.04 alcohol-concentration threshold for specified administrative consequences while operating a commercial motor vehicle. That is not a universal replacement for every criminal DWI element or a statement that lower concentrations are safe. The vehicle, test, conduct and proceeding must be identified before a threshold can be applied correctly.

Can an occupational license let me keep driving a truck?

No. Section 522.086 prohibits an essential-need or occupational license from authorizing commercial motor vehicle operation while the person is disqualified. Possible permission to drive a noncommercial vehicle is a different question. A work-related need does not erase this distinction.

What should a CDL holder bring to a consultation?

CDL consultation checklist
Document or factWhy it matters
License or learner permit held on the incident dateIdentifies the commercial status relevant to the allegation.
Vehicle and cargo detailsCommercial operation and hazardous-material circumstances can affect the applicable rules.
Every DPS notice and orderSeparates suspension, disqualification, deadlines and effective dates.
Prior dispositions and driving recordPrior events can affect the consequences; do not rely on memory alone.
Employment and reporting paperworkAllows counsel to identify separate obligations without guessing from a generic policy.

How long will a disqualification last?

There is no single period that accurately describes every CDL case. Section 522.081 distinguishes grounds and histories, and some circumstances produce substantially longer consequences. Have counsel identify the subsection and effective dates on the actual order before making work plans. Do not treat a projected end date as confirmation that all reinstatement requirements are complete.

What should I do while the case is pending?

Keep notices, envelopes, hearing confirmations and court documents together. Ask counsel which deadlines and reporting duties apply now. Before operating, verify both ordinary license status and commercial eligibility. An employer's instruction or a pending criminal case is not proof that driving is authorized.

For a North Texas arrest, provide the county, agency and court information to the intake team. A useful case review begins with those facts and the actual records, not a promise that an occupation or first arrest guarantees a particular result.
