Blood Tests After a Fatal DWI Crash in Texas
Learn what a blood result can and cannot establish in a Texas fatal DWI investigation, including collection timing and laboratory records.
In short: A blood-test result is one part of a Texas intoxication manslaughter investigation. Collection timing, identification of the sample, analytical reliability and the relationship between the result and operation all matter. A numerical result does not independently prove who drove or why the crash occurred.

Why does the collection time matter?
The time of the draw may differ from the time of driving. Any attempt to interpret an earlier concentration must be assessed against its assumptions and supporting information. A later number should not silently become an earlier measurement.
Which laboratory records deserve review?
Counsel can examine the collection paperwork, custody history, analytical reports and available quality-control information. A clerical discrepancy does not automatically invalidate a result, but it should be understood before the result is treated as reliable.
Does a valid test resolve the entire charge?
No. Operation, the applicable intoxication definition and causation remain distinct issues. Counsel should also evaluate the legal basis for obtaining the sample and any supported evidentiary challenge, without promising exclusion simply because a blood draw occurred.
A practical example and questions for counsel
Hypothetical example: Suppose a blood sample was taken well after the collision. The reported concentration belongs to that sample at the relevant testing context; any opinion about the earlier driving period requires explanation. Counsel should identify the draw time, the alleged operation time and the assumptions used in any backward estimate. The same review should distinguish a laboratory measurement from a witness’s observations of impairment. Neither should silently substitute for the other. A sound challenge addresses the particular record and method rather than relying on a universal claim that late testing is invalid.
How this fits Texas law
Intoxication manslaughter under section 49.08 requires a covered operation or activity, intoxication, and a death caused by reason of that intoxication. For a motor vehicle, operation in a public place is part of the statute. The offense is generally second degree, subject to section 49.09. An arrest, laboratory result and crash reconstruction each answer different questions.
