Expert Evidence in a Texas Arson Investigation

Understand origin, cause and intent as separate questions in Texas arson investigations and what records an independent review may need.

In short: A fire investigator’s origin-and-cause opinion does not automatically prove who started a fire or the required criminal intent. A Texas arson defense review should examine the methods, underlying observations, alternative causes and limits of each conclusion, alongside the charged statutory elements.

Does an undetermined cause establish arson?

No. An inability to determine a cause is not itself proof of intentional criminal conduct. Conversely, it does not resolve every other item of evidence. Counsel should evaluate the whole record without converting uncertainty into a conclusion.

What should an independent review examine?

The review may need complete photographs, diagrams, sample records, laboratory reports and the investigator’s reasoning. Ask whether alternative causes were evaluated and which observations support exclusion of those alternatives.

Why do the original materials matter?

A summary report may omit the basis for an inference or the limits of a test. Preserve access to the underlying material through counsel. Independent review should test the evidence, not merely commission a competing conclusion without examining the same facts.

A practical example and questions for counsel

Hypothetical example: Suppose a final report concludes that a fire was deliberately set but the underlying photographs and sample records are incomplete. That gap does not by itself prove the conclusion wrong, yet it limits what an independent reviewer can assess. Counsel should identify the missing material, whether it still exists and which inference depends on it. Ask the reviewer to distinguish a disagreement about method from a disagreement about the facts. A reasoned critique should explain why an omission matters to the proposed cause rather than merely point out that the file is imperfect.

How this fits Texas law

Texas arson law contains several routes with different mental states and consequences. Section 28.02(a) concerns a fire or explosion with intent to damage specified property under listed circumstances; other subsections address certain reckless damage or injury. Not every fire is arson, and not every arson subsection has the same felony level.
