The statute lists purposes such as ransom, hostage-taking or facilitating a felony, and separately covers abduction involving use or exhibition of a deadly weapon.

Is every restriction on movement aggravated kidnapping?

No. Restraint, abduction and an aggravating circumstance are distinct statutory questions. Counsel should identify how the State proposes to prove each one rather than assume that any blocked exit establishes the most serious charge.

Must someone be taken to another city?

No such travel requirement appears in the abduction definition. Confinement and the means of preventing liberation can matter. Distance alone does not determine whether the statutory elements are present.

What should the factual review cover?

Review the location, exits, alleged threats, communications and the sequence of release. Distinguish what each person could actually do from assumptions based on the setting. The specific purpose alleged should be tied to evidence, not inferred solely from the charge name.

A practical example and questions for counsel

Hypothetical example: Suppose someone alleges being prevented from leaving a room. Counsel should examine the restriction, lack of consent and whether the evidence supports abduction as defined, then separately examine the alleged aggravating purpose or weapon. A frightening encounter may supply relevant evidence without automatically satisfying every element. Record the available exits, words and actions without converting assumptions into facts. The analysis should also identify the period the State says constituted the offense, because circumstances before and after that interval may differ.

How this fits Texas law

Texas distinguishes restraint from abduction. Abduction involves restraint with the intent to prevent liberation through concealment or deadly force as defined in section 20.01. Section 20.04 adds specified purposes or use or exhibition of a deadly weapon. It is generally first degree, with a punishment-stage safe-release provision that has its own burden of proof.
